Welcome to read the Mxiqi User Service Agreement (hereinafter referred to as the “Agreement”). The terms and conditions set forth in this Agreement apply to your use of all products and services provided by Mxiqi (hereinafter referred to as the “User”).
Confirmation of the Service Agreement
(a) Mxiqi (Beijing) Network Technology Co., Ltd. and its relevant affiliated enterprises (hereinafter collectively referred to as “Mxiqi”) agree to provide internet and mobile network-based services (hereinafter referred to as the “Services”) in accordance with the provisions of this Agreement and the operating rules issued by Mxiqi from time to time.
(b) The service user (hereinafter referred to as the “User”) shall, on the basis of understanding the entire content of this Agreement and independent thinking, approve and agree to all terms of this Agreement and complete all registration procedures in accordance with the prompts on the page. The User’s registration, login, use and other acts shall be deemed as full acceptance of this Agreement and all rules and norms published by Mxiqi.
(c) Mxiqi shall have the right to supervise, prompt, inspect and correct all activities on its products including but not limited to mobile apps (including mini-programs) and PC websites.
Service Content
(a) The specific content of the Services shall be provided by Mxiqi in accordance with actual circumstances, including but not limited to authorizing Users to upload, search and push relevant information to associated Users through their accounts, and authorizing Users to collect and share such information. Mxiqi reserves the right to upgrade or adjust the form of the Services or products it provides, and will notify Users of such changes through content updates on mini-programs, mobile apps, websites and other platforms, without separate notification to individual Users.
(b) The Services provided by Mxiqi may include advertisements, and the User agrees to the display of advertisements provided by third-party suppliers and partners in the course of using the Services.
(c) Mxiqi only provides technical services and other services related to the Services. In addition, all equipment related to the network services (such as personal computers, mobile phones and other devices for accessing the internet or mobile networks) and the corresponding expenses (such as telephone and internet fees for internet access, mobile phone fees for mobile network use) shall be borne by the User alone.
Service Change, Interruption or Termination
(a) In view of the particularities of network services (including but not limited to force majeure, network stability, system stability, technical failures, the User’s location, the User’s device shutdown, mobile phone viruses or malicious cyber attacks, and any other technical, internet, communication line or content infringement issues), the User agrees that Mxiqi reserves the right to interrupt or terminate part or all of the Services at any time. Mxiqi will notify the User in a reasonable manner as timely as possible and make repairs to the maximum extent at the first opportunity. However, Mxiqi shall not be liable for any failure of the User to send, receive or read information, or the sending/receiving of incorrect information arising therefrom, and the User shall bear all such risks.
(b) The User understands that Mxiqi may need to conduct regular or irregular maintenance and overhaul of the service-providing platforms or relevant equipment. If the Services are interrupted within a reasonable period due to such circumstances, Mxiqi will notify the User in advance as much as possible, but shall not be liable for any such interruption.
(c) If the personal information provided by the User is untrue, or the User violates national laws, regulations, policies or the usage rules stipulated in this Agreement, Mxiqi reserves the right to interrupt or terminate the provision of Services under this Agreement to the User at any time, without bearing any liability to the User or any third party.
(d) For accounts blocked due to triggering the system risk control policy, the following procedures shall be completed for unblocking: 1. The User completes real-name authentication within the mobile app or mini-program; 2. The User provides a photo of the front and back of the ID card and a photo of the User holding the ID card to the platform customer service; 3. The platform customer service will unblock the account after verifying the authenticity of the identity information and confirming no associated risks.
Usage Rules
(a) When applying for service registration, the User must provide accurate subject information to Mxiqi (for individual Users, including full name, gender, date of birth, phone number, email address, etc.; for corporate Users, including enterprise name, registered address, registration number, etc.). The User must update such subject information in a timely manner if any changes occur. The User shall be liable for any losses suffered by both parties to the Agreement or any third party due to the untruthfulness of the information provided by the User.
(b) Upon successful registration, the User will obtain an account and a self-set password, for which the User shall be solely responsible for safekeeping. The User shall bear all relevant legal liabilities for all acts conducted through the account.
In the course of using the Services, the User must comply with the following principles:
- Abide by the relevant laws and regulations of the People’s Republic of China;
- Not use the Services for any illegal purposes;
- Comply with all network protocols, rules and procedures related to network services;
- Not use the service system to conduct any acts that may adversely affect the normal operation of the internet;
- Not use the network service system to conduct any acts that are detrimental to Mxiqi.(c) The User shall not use the Services to create, upload, send or disseminate sensitive information or information in violation of national laws and regulations, including but not limited to the following:
- Information opposing the basic principles established by the Constitution;
- Information endangering national security, divulging state secrets, subverting state power or undermining national unity;
- Information damaging national honor and interests;
- Information inciting ethnic hatred or discrimination, or undermining ethnic unity;
- Information undermining the national religious policy, or advocating cults and feudal superstitions;
- Information spreading rumors, disturbing social order or undermining social stability;
- Information spreading obscenity, pornography, gambling, violence, murder, terror or instigating crimes;
- Information insulting or slandering others, or infringing upon the legitimate rights and interests of others;
- Information containing other content prohibited by laws, administrative regulations or the platform.(d) The User agrees not to use any other User’s account or password under any circumstances. The User agrees to immediately notify Mxiqi if the User suspects that others are using the User’s account or password.(e) The User has the right to modify or delete personal information, registration information and transmitted content in the Services; however, the deletion of relevant information will also result in the deletion of any text and images stored by the User in the system, and the User shall bear the corresponding risks.(f) If the User violates any terms of this Agreement, Mxiqi reserves the right to terminate the provision of Services to the breaching User’s account in accordance with this Agreement.(g) If the User fails to log in to the registered account for a long time, Mxiqi reserves the right to recover the account to avoid resource waste, and the User shall bear all problems arising therefrom.(h) For Users who commit serious breaches of contract in platform-related auctions or are deemed by the platform to have intentionally breached the contract, the platform reserves the right to block their accounts, and the User shall bear all consequences arising therefrom. The platform reserves the right to pursue legal liabilities against such Users in accordance with relevant laws and regulations.
Intellectual Property Rights
(a) All text, images, logos, audio and video materials contained in the Services provided by Mxiqi are protected by copyright, trademark right, patent right and other property right laws.
(b) Without the consent of the relevant right holders and Mxiqi, the above-mentioned materials shall not be displayed on any other third-party platform or used for any other commercial purposes in any form. The User shall not copy, modify, compile the above-mentioned content or create derivative works related thereto without authorization.
Privacy Protection
(a) “Privacy” as referred to in this Agreement includes the content of the User’s personal information as stipulated in Article 4 of the Regulations on the Protection of Personal Information of Telecommunications and Internet Users, as well as the content that shall be included in privacy as explicitly stipulated in laws and regulations formulated or revised from time to time in the future.
(b) Protecting the User’s privacy and personal data is a basic system of Mxiqi. Mxiqi will take various institutional, security technical and procedural measures to protect the User’s privacy and personal data from unauthorized access, use or disclosure. Mxiqi undertakes not to disclose the individual User’s registration information and non-public content stored on Mxiqi during the User’s use of the Services to any third party other than cooperative entities, or use such information for any illegal purposes, except in the following circumstances:
- Obtaining the explicit authorization of the User in advance;
- Complying with the requirements of relevant laws and regulations;
- Following the instructions of relevant government competent departments;
- Safeguarding the interests of the public;
- It is necessary to safeguard Mxiqi’s legitimate rights and interests when the User infringes upon the legitimate rights and interests of Mxiqi under this Agreement.(c) In the process of registering an app account or using app services, the User is required to provide certain necessary information, such as full name, phone number, email address, gender, date of birth, enterprise name, registered address, registration number, etc. The User is required to fill in a mobile phone number for account registration services or user identity verification; some functions require the User’s authorization to access the camera or photo album; some functions require the User’s authorization to access the mobile phone address book. If the User refuses to authorize or provides incomplete information, the User will be unable to use the Services or be restricted during use. For the information provided with the User’s authorization, Mxiqi undertakes to take measures to protect the security of the User’s personal information.(d) To provide a better user experience and improve the quality of app services, Mxiqi may collect, use or provide non-personal privacy information of the User to third parties. Mxiqi will supervise and manage the third parties’ use of the User’s personal data and make every effort to protect the security of the User’s personal information.
Disclaimer
(a) The User shall comply with national laws, regulations and policies in the course of using the Services, and bear all legal liabilities for the information and content created, uploaded, sent or disseminated by the User, which shall be unrelated to Mxiqi.
(b) If any information and content displayed or pushed to the User on the app page is recommended to the User by Mxiqi through technical means by searching, locating and matching from any third-party website on the internet in accordance with the User’s instructions, rather than independently created by Mxiqi, such displayed or pushed information and content shall not represent the views of Mxiqi and the app, and Mxiqi shall not be liable for the accuracy and correctness of the above-mentioned information.
(c) All text, images, logos, audio and video materials contained in the app services provided by Mxiqi are for educational purposes only and do not involve any commercial activities of physical goods.
(d) If any information and content displayed or pushed to the User on the app page is suspected of infringing the intellectual property rights of any third party, the right holder and relevant interested parties shall send a right notice to Mxiqi. After verification, Mxiqi reserves the right to take measures including but not limited to disconnecting the link to the infringing content or deleting and stopping the transmission of the infringing content in accordance with relevant laws and regulations; however, Mxiqi shall not bear legal liabilities for such infringing content.
(e) If the User violates the provisions of this Agreement, resulting in any claims, demands or losses asserted by any third party (including reasonable attorney’s fees), the User agrees to indemnify Mxiqi and hold Mxiqi harmless therefrom.
Other Terms
(a) Mxiqi reserves the right to modify any terms of this Agreement at any time. In the event of any changes to the content of this Agreement, Mxiqi will publish the revised Agreement on the app platform or notify Users of the changes through other appropriate means. If the User disagrees with the above-mentioned changes, the User has the right to stop using the Services; however, the User’s continued use of the Services shall be deemed as acceptance of the revisions to the relevant terms of this Agreement by Mxiqi.
(b) If any term of this Agreement is partially or fully invalid or unenforceable for any reason, the remaining terms of this Agreement shall remain valid and binding.
(c) The conclusion, performance and interpretation of this Agreement, as well as the settlement of disputes, shall be governed by the laws of the People’s Republic of China and subject to the jurisdiction of the people’s courts of the People’s Republic of China. In the event of any dispute or controversy between the parties regarding the content or performance of this Agreement, the parties shall first seek to resolve it through friendly negotiation. If the negotiation fails, either party may file a lawsuit with the competent people’s court at the place where Mxiqi is located.
(d) The copyright of this Agreement shall belong to Mxiqi. Mxiqi shall reserve the final right to interpret and modify all terms of this Agreement.
